This privacy policy applies to your use of the website located at www.contractcollective.com (the “Site”) and linking to this policy.  This policy outlines our practices and policies with respect to our collection of personal information as well as other privacy related matters relating to the Site.  Please review this policy carefully.  By using the Site, you consent to our collection and use of your information and our communication with you as described in this policy.

This policy applies to information we collect:

  • on or through the Site;
  • in email or other electronic communications between you and us or the Site in relation to the Site.

This policy does NOT apply to information collected by:

  • us offline or through other means not provided by you (if any); or
  • any third party, including through any application that may link to or be accessible from the Site.

Information Collected

We collect personally identifiable information (information that identifies an individual person) that you submit to the Site, which includes or may include the following:

  • your name, email address, and other contact information;
  • professional licensing information such as bar number;
  • your photo, biographical and other professional information;
  • your password for the Site;
  • if you make purchases, your credit card information (which is submitted through the Site, but collected and processed by a third-party credit card processing service engaged by us for the Site); and
  • if you sell documents, your account identification information for Paypal or other similar means allowing us to send you related sale proceeds.

Additionally, we collect information contained in documents you submit for sale, document descriptions, comments, and other information you submit to the Site or send to us in connection with the Site, which ordinarily should not, but may contain personal information. 

The above describes information that you would deliberately submit.  We also collect technical information you do not deliberately send to us such as: your IP address and name of your Internet service provider, time and date information, and other information from web logs and cookies set by the Site to store your session data and preferences, information about your browser, operating system and language, technical identification information for your PayPal or similar payment receipt account through which we send you proceeds of your sales and other meta- and technical information.  Some of this data is may be personally identifiable.

Note that we use third party commercial hosting and related infrastructure located in the United States. Therefore, if you are located outside the United States, information we collect from you will be transferred to the United States.   However, the Site is intended for use by persons located in the United States and any privacy or data protection matters are governed by domestic U.S. law.  We do not undertake compliance with privacy or other laws outside the United States including European Union data protection laws.  If you are located outside the United States and are concerned about transferring your information to the United States or about compliance with your privacy or other laws outside the United States, you should not use the Site.

With respect to documents you submit, you should be careful to redact any personal, privileged, or confidential information contained in the document including tracked changes, document properties, and other metadata that you do not intend to share with others.  We are not responsible for identifying such information in the documents you submit the results in improper or inadvertent disclosures of confidential information through the Site.

PLEASE NOTE: Anonymous Document Submission is no Guarantee of Anonymity. The Site allows users to offer documents for sale through the Site without associating their user or personal name with the document to other users (an “Anonymous Submission”).  When this option is selected in submitting a document, the description page for the document will list the user offering the document as “Anonymous”.  This is intended, for example, to allow a user to offer a document that may have imperfections (although still useful to purchasers) without generally and publicly associating their name with the document.  However, this feature should not be relied on as an absolute guarantee that the user will never be revealed as having submitted, offered, or sold the document.  Documents you submit are linked to you and your name and other information in our database.  Technical and human errors in operation of the Site, identifying information revealed in communications, subpoenas, and other similar actions and proceedings, identifying meta- or other information in the document itself, and other causes could result in you being identified as the source of an Anonymous Submission.  

Cookies and Related Technologies

The Site uses cookies and other similar technologies for both functional and analytical purposes.  Functional use means using such technologies to make a feature or part of the Site operate.  This includes validating your log-in, storing your Site preferences, facilitating your staying logged in to the Site and use of the Site’s shopping cart, and personalizing your use of the Site.  Analytical use means using the technology to gather and process information about you and your use of the Site.   Such analytic uses are to operate, troubleshoot, and improve the Site and to generate anonymized performance and analytic data.  Such technologies enable us to collect certain of your technical information like your IP address, browser type, information about how and when you used the Site and similar information.  Certain of these technologies set small bits of data on your computer and they may be set by our Site or by third parties such as Google.   Cookies stored by the Site on your device may persist for only your session or for much longer depending upon the cookie.  You can disable and delete cookies through your browser preferences, however, this may limit or disable certain functionality or parts of the Site.  You can learn more about cookies at http://www.allaboutcookies.org/.

How Information Collected is Used

We only use your information to operate and maintain the Site and otherewise in the ways described in our Terms of Service, to provide the services offered through the Site, to communicate with you about the Site including announcements and offers, and to analyze how the Site is used and to improve the Site and its offerings. We may also transmit information between you and other members of the Site and use your information to enforce our Terms of Service and other legal rights or to assist in resolving disputes between you and us or you and other users.

We may also aggregate your information with information of other users submitted through the Site and with information obtained from third parties and we may use this information to operate and improve the Site and its offerings, and select and deliver other offerings and notifications to you (depending on your communication preferences).

We may also disclose information about you if we determine that disclosure is reasonably necessary to enforce our terms and conditions or protect our operations or users or to comply with law, including complying with a subpoena or the reasonable requests of law enforcement. Additionally, in the event of our reorganization, merger, or sale we may transfer any and all personal information we maintain to the relevant third party and otherwise share the information with participants in that process.

Note that we do not independently verify the actual identity of someone who uses the Site under your username and password.  You should select a safe password (for example, by having reasonable length and complexity and avoiding easy to guess passwords such as “password”) and you should keep your password confidential.  You are responsible for use of the Site under your username and password.  

How We Share Your Information with Third Parties

We may share your information with third parties as follows:

  • We may share your information with third party service providers for the purposes of operating the Site.  For example, we use third party hosting infrastructure services and other similar technical service providers to operate and host the Site that may involve sharing of or granting access to your information. 
  • We may share your information with third party financial services to process payments and to deliver proceeds of document sales through the Site, which involves sharing certain of your data with such service providers.  
  • We may share your information, including your documents with other users of the Site in the operation of the Site (for example, delivering a document you sell to the purchaser).
  • We may share documents you submit for sale to third party services providers for processing and analysis.  
  • Any information you submit to the Site in documents you offer for sale or that is displayed in portions of the Site viewable by other users such as comments and descriptions you submit about a document will be available to third parties. Even where you delete information you’ve submitted from the Site, copies may remain viewable in cached and archived pages of our Site or with others who have copied or saved that information.
  • We may sell, rent, or otherwise provide to third parties your information aggregated with other Site user data in a form that does not specifically identify you.
  • We may share your information with law enforcement or other governmental entities.
  • In the event of our reorganization, merger, or sale we may transfer any and all information we collect from you to the relevant third party.

Accessing, Correcting, or Deleting your Information

Certain of your information stored in the Site you can access, modify, or delete such as your profile information.  (Certain required information you can only modify, but not leave blank.)  See your profile page for this information.  Other information such as comments you submit cannot be modified or removed by you once submitted.  You can make a document you’ve offered to other users no longer available for sale, however, this does not remove the document from our database and prior purchasers of the document remain able to re-download the document from the Site even after you have made the document no longer available for sale. 

If you wish to terminate your user account, you may request that we do so by contacting us at the email below in this section, however any such termination will not remove your information stored in the Site.

If you wish to have any of your information on the Site deleted, modified, or corrected in a manner that you are not able to accomplish yourself through the Site, you can send a request with appropriate details to support@contractcollective.com. We will make an effort, within a reasonable time thereafter, to accommodate your request although technical, practical, and other considerations may limit or prevent our ability to do so.

Use of the Site by Children

The Site is not directed to or intended for children under eighteen years of age.  We do not knowingly collect personal information of or from such children.  The Site is intended for licensed attorneys at least eighteen years of age or older.  If you are younger than thirteen, please do not submit any information, personal or otherwise, to the Site. If a person 13 years of age or younger has provided personal information to us, a parent or guardian of such person can and should contact us at support@contractcollective.com so that we can endeavor remove such personal information from the Site.

California – Disclosure Regarding Do Not Track

The Site does not track, or knowingly enable any third party to track users of the Site over time and across third party websites to provide targeted advertising and therefore does not respond to Do Not Track (DNT) signals.

How We Protect Your Information

We take various measures to protect your privacy and data, but we cannot ensure or warrant the security of any information you transmit to us or the Site or guarantee that such information will not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or administrative safeguards or otherwise in an unauthorized manner. When you enter sensitive information (such as your password) on our registration or order forms, we encrypt that information using secure socket layer technology (SSL).  The third-party credit card processing service provider the Site uses to receive and process your credit card information uses security measures to protect your credit card information that are not controlled by us.  No method of transmission over the Internet or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee your information’s absolute security.

Notification Procedures

We provide notifications to you, including those in general operation of the Site, required by law and for marketing or other business-related purposes, via email, written or hard copy notice, or through conspicuous posting of the notice on the Site, as determined by us in our sole discretion. We reserve the right to determine the form and means of providing notifications to you, provided that you may opt out of certain means and types of notifications.  Such notifications will be made to contact information you have provided us in your profile and so your contact information should be kept up-to-date.

Links to Other Web Sites

We are not responsible for the practices employed by websites or services linked to or from the Site, including the information or content contained on them. Please remember that when you use a link to go from the Site to another website or service, our Privacy Policy does not apply to those third-party websites or services. Your browsing and interaction on any third-party website or service are subject to that third-party’s own rules and policies.

Changes to Our Privacy Policy

We may update this Privacy Policy from time to time by posting a new version on the Site and we will update the effective date above to reflect the date of the changes. You should visit this page occasionally to ensure you agree with any changes.
